In this Agreement, the terms "Datenovo", "we", and similar expressions refer to BERLIN GMBH LLC. By purchasing any product or service through Datenovo, the user declares that they have read, understood, and fully accepted all of the following terms and conditions.
Cancellation and Refund Policy
All products and services offered on the site are personalized and digital in nature and cannot be canceled or refunded under any circumstances.
Procurement of Third-Party Services
Within the scope of the products and services offered, products or services may be procured from third parties when necessary. This is entirely at the discretion of Datenovo.
Transfer of Service
Datenovo may delegate the execution of tasks and transactions related to services and products to third parties when deemed necessary.
Interruption or Termination of Service
The products and services offered are in no way guaranteed to be 100% available; they are provided only to the extent possible.
Due to reasons beyond Datenovo’s control—such as internet outages, global crises, natural disasters, or other extraordinary local/global situations—services may be temporarily suspended or completely canceled. In such cases, no cancellations or refunds will be made.
Legal Usage Responsibility
It is the user's sole responsibility to use the products and services in accordance with local and national laws. Datenovo is not liable for any material or immaterial damages that may arise as a result of usage.
Delivery Time
Unless otherwise stated on the relevant product page, the delivery time for products and services is a minimum of 3 business days. Official, religious, and weekend holidays are not included in this period.
The delivery period only begins after the user provides all required information and documents in full. The time taken to provide such documents/information is not included in the delivery period.
In cases where third-party services are required for a product, any delays caused by such parties are not included in the delivery period.
Pricing and Payment Methods
All product and service prices are specified inclusive of VAT. Payment methods are presented to the user on the order completion screen.
Recurring Payment Services
If the purchased product or service is valid for a certain period (e.g., monthly, yearly) and is not renewed at the end of that period, the respective product or service will be canceled.
Backup Responsibility
Datenovo does not provide any backup service for delivered products or services. The user is responsible for retaining all information, documents, and usage details.
Support Period
Support services are not unlimited, and the support period is specified on the relevant product page. The provision of support does not guarantee that the product or service will work 100% error-free.
Server Services
For products and services under the servers category, only the initial setup is provided. Afterward, all management and responsibility for the server belong to the user.
Software Sales
System requirements for software offered for sale on Datenovo are specified on the product page. When these requirements are met by the user, the initial installation is performed by Datenovo. Post-installation usage is entirely the user's responsibility.
Application-Based Services
Services such as company formation in the USA, opening a Google/Apple developer account, Google Ads account, obtaining an EIN number, or opening a bank account are considered application-based services.
The successful outcome of such applications is not guaranteed. Negative results are entirely the responsibility of the user, and no cancellation or refund is possible in these cases.
Request for Information and Documents
Datenovo may request any documents or information from the user necessary to provide a product or service. These documents may be shared with third parties solely for the provision of the relevant service. Datenovo is not responsible for any damages that may arise in this context.
Right to Amend the Agreement
Datenovo has the exclusive right to change, update, or remove any and all provisions and conditions of this agreement. Such changes may be made without prior notice.
Right to Suspend Service
Datenovo may temporarily or permanently suspend or cancel any product or service it offers, without prior notice and without providing any reason. In such cases, no cancellation or refund will be made.
Right to Cancel User Services
Datenovo reserves the right to unilaterally suspend, pause, or cancel any product or service purchased by any user. In such cases, no cancellation or refund will be paid.
Communication and Support Process
Users carry out all post-sales processes through the support ticket system within their user accounts on the site.
Datenovo does not provide post-sales support services by phone.
All correspondence, transactions, and records kept in Datenovo systems constitute legal evidence.
